ICRC Convoy in Sudan

NAIROBI / KHARTOUM — The Firdaous Initiative for Academic Excellence (FIAE) notes with utter dismay and profound sorrow the deliberate, unprovoked armed attack on a clearly marked humanitarian convoy of the International Committee of the Red Cross (ICRC) in the Al-Shajara neighborhood of Khartoum, Sudan, on 10 December 2023.

The convoy—which was operating under prior security clearance and coordination with all warring parties to evacuate over a hundred vulnerable civilians, including foreign nationals, children, and hospital patients—came under heavy gunfire, resulting in the tragic death of two innocent civilians and severe injuries to seven individuals, including three dedicated ICRC aid workers.

Violations of the 1949 Geneva Conventions & Additional Protocols

FIAE reminds the Sudanese Armed Forces (SAF), the Rapid Support Forces (RSF), and allied militias that medical and humanitarian personnel displaying the distinctive Red Cross and Red Crescent emblems enjoy absolute protected status under Customary International Humanitarian Law (Rule 25 & Rule 31) and the Geneva Convention IV.

Direct Targeting of Humanitarian Workers is a War Crime

Under Article 8(2)(e)(iii) of the Rome Statute of the International Criminal Court (ICC), intentionally directing attacks against personnel, installations, material, units, or vehicles involved in a humanitarian assistance mission in accordance with the Charter of the United Nations constitutes a grave war crime.

"Humanitarian workers are not targets. The emblem of the Red Cross is a universal sign of neutral, impartial protection. When guns are turned upon aid convoys, the fundamental fabric of international legal order is shattered."

Four-Point Demand by the FIAE Directorate

In response to this catastrophic breach of international humanitarian law, FIAE demands:

  1. Immediate, Independent Investigation: An impartial inquiry led by the African Union Peace and Security Council (AU PSC) and UN OHCHR to identify and prosecute the perpetrators.
  2. Unconditional Humanitarian Corridors: An immediate, unhindered ceasefire guarantee for all medical evacuations and humanitarian relief distribution across Khartoum, Darfur, and Kordofan.
  3. Re-commitment to the Jeddah Declaration: Strict adherence by all belligerents to their signed commitments under the Jeddah Declaration of Commitment to Protect the Civilians of Sudan.
  4. Protection of Youth Volunteers: Safeguarding grassroots Sudanese Emergency Response Rooms (ERRs) and student medical responders who operate at daily risk of arbitrary detention and assassination.

A Call to African Youth and Legal Scholars

FIAE urges African law students, young legal practitioners, and peacebuilders to actively document, research, and monitor IHL violations occurring across Sudan, Eastern DRC, and the Sahel. The culture of impunity on the African continent can only be broken when future jurists relentlessly uphold the Geneva Conventions.
